1. Information We Collect

Luxe collects the following categories of personal data:

Your name and email address when you create an account, plus optional profile information such as phone number and store affiliation. Audio recordings of sales conversations you capture using Luxe's recording feature. Text transcripts generated from your audio recordings through AI transcription. Client information you enter into Luxe's client management features, which may include names, email addresses, phone numbers, notes, preferences, purchase history, and follow-up dates. Context notes, conversation titles, location details, and other information you attach to your recordings or client interactions. Usage and analytics data about how you use Luxe, such as feature usage events and recording frequency, used to operate, secure, monitor, and improve the platform.

2. Audio Recordings

Luxe records audio conversations only after the user initiates recording and the required participant consent has been obtained.

When recording is active, Luxe displays a persistent visual indication that recording is occurring, including a Recording label, recording indicator, timer, and clearly visible Stop Recording control. The recording state cannot be hidden or disabled.

Recordings are protected using encryption in transit and at rest. Transcriptions are generated using AI and stored as part of your Luxe account. You may delete recordings and transcripts through available account controls.

3. Client Consent for Recordings

Luxe is designed for consent-based recording of sales conversations. Users are responsible for obtaining all consent required by applicable law from conversation participants before initiating a recording.

Recording and privacy requirements vary by jurisdiction. Users are responsible for complying with applicable recording, privacy, employment, and other laws governing their use of Luxe.

Luxe does not provide legal advice regarding recording-consent requirements.

4. How We Use Your Information

We use personal data to:

Provide Luxe's core functionality, including capturing, storing, and managing conversations. Transcribe audio recordings into text. Analyze conversation patterns and generate coaching insights, competency scores, and performance evaluations. Generate AI-powered summaries, coaching recommendations, follow-up drafts, and other personalized recommendations. Evaluate practice and role-play sessions for training and certification purposes. Maintain client relationship and follow-up information. Sync information with connected CRM platforms, such as HubSpot and Salesforce, when initiated or configured by the user or customer. Send notifications, follow-up drafts, and alerts you have configured. Authenticate accounts and provide account functionality. Operate, secure, monitor, maintain, and improve the Luxe platform, including analytics, error monitoring, and reliability.

5. AI Processing and Consent

Luxe uses third-party artificial intelligence services to transcribe conversations, analyze conversation content, provide AI-powered coaching and practice, and evaluate behavioral assessments across three core AI-enabled features:

Conversation Analysis — transcribes audio recordings, analyzes conversation patterns, and generates coaching insights, competency scores, follow-up drafts, and performance evaluations. Luxe Practice — powers AI practice conversations with luxury client personas and provides personalized coaching after each practice session. Luxe Academy — evaluates practice and role-play sessions for training and certification, scores demonstrations against the competency framework, and generates credentialing assessments.

When applicable to the feature being used:

OpenAI receives conversation audio for transcription and may receive transcripts and conversation context for analysis, summary generation, and coaching-related functionality. Anthropic receives transcripts and conversation context for AI-powered functionality such as coaching insights, competency analysis, follow-up drafts, and practice-session evaluations. Agnost AI provides AI observability and evaluation services. To help Luxe monitor, evaluate, and improve AI-powered features, Agnost AI may receive workflow metadata and AI processing data, which may include user ID, email, role or plan, workflow metadata, AI inputs, and AI outputs where applicable. Agnost AI does not receive raw conversation audio. The information transmitted may contain personal data included in the conversation or associated context.

Luxe does not transmit applicable personal data to these third-party AI providers until the user has affirmatively granted permission through Luxe's in-app AI Processing Consent flow. Acceptance of Luxe's Terms of Service or Privacy Policy, creation of an account, or continued use of Luxe does not by itself constitute consent to third-party AI processing.

Users may decline AI processing by selecting Not Now when presented with the consent request. Users who previously granted consent may withdraw it through Settings → Privacy.

If AI-processing consent is declined or withdrawn, Luxe will prevent new applicable personal data from being transmitted to third-party AI providers. Features that require third-party AI processing — including applicable transcription, conversation analysis, coaching insights, follow-up generation, practice evaluation, and Academy assessment — will be unavailable until consent is granted again. Non-AI functionality, such as conversation recording and client list management, remains available where applicable.

Withdrawing AI-processing consent does not automatically delete data that has already been processed and stored within your Luxe account. Previously processed information is not automatically re-transmitted solely because consent is later withdrawn. To delete existing data, use the available account controls or request account deletion as described in Section 8.

Luxe does not use conversation audio, transcripts, or client data to train external AI models. OpenAI, Anthropic, and Agnost AI process data provided through Luxe for purposes of providing the AI functionality used by Luxe, subject to the applicable service arrangements and data-protection terms governing those services.

AI-generated content may contain errors or inaccuracies and is intended as guidance rather than a replacement for human judgment.

6. Data Sharing and Service Providers

We do not sell personal data.

We share personal data only as necessary to provide, operate, secure, integrate, and support Luxe. Depending on the features you use, service providers may include:

OpenAI — provides AI transcription and analysis services. As described above, it may receive conversation audio, transcripts, and conversation context after required AI-processing consent has been granted. Anthropic — provides AI analysis and generation services. As described above, it may receive transcripts and conversation context after required AI-processing consent has been granted. Agnost AI — provides AI observability and evaluation services. As described above, it may receive workflow metadata, AI inputs, and AI outputs — which may include user ID, email, and role or plan — after required AI-processing consent has been granted. Cloud infrastructure and storage providers — host Luxe services and store application data and recordings. Analytics, observability, and error-monitoring providers — help Luxe understand platform usage, monitor reliability, secure the Service, and diagnose technical issues. Authentication and communication providers — support account authentication, notifications, and account-related communications. CRM and commerce integrations, including services such as HubSpot and Salesforce — receive applicable conversation or client data when a user or customer connects and uses those integrations.

We require service providers handling personal data on our behalf to maintain appropriate privacy and security protections. We may also disclose information where required by applicable law, regulation, legal process, or valid governmental request.

7. Your Privacy Rights and Choices

Depending on your jurisdiction, you may have rights concerning your personal data, including rights available under the GDPR, CCPA/CPRA, and similar applicable privacy laws.

Depending on applicable law, these rights may include the ability to:

Request access to personal data we maintain about you. Request a portable copy of your data. Correct inaccurate personal information. Request deletion of your account and associated personal data. Withdraw consent for processing based on consent. Opt out of certain processing where applicable.

AI-processing consent can be reviewed and withdrawn through Settings → Privacy.

Account deletion is available through Luxe's account deletion controls or by contacting hello@luxeretail.co.

For other privacy requests, contact hello@luxeretail.co.

8. Data Retention and Deletion

We retain personal data for as long as reasonably necessary to provide Luxe, maintain accounts, satisfy legal or contractual obligations, resolve disputes, protect the Service, and enforce our agreements.

Users may delete certain content, including conversations and client information, using available product controls.

When an account is deleted or terminated, associated personal data will generally be deleted or de-identified within 30 days, except where longer retention is required or permitted by law, necessary to establish or defend legal claims, necessary for legitimate security or business purposes, or temporarily maintained in secure backups.

Users may request account deletion through the account deletion controls available within Luxe or by contacting hello@luxeretail.co.

9. International Data Transfers

Luxe is operated from the United States. Personal data may be processed in the United States and other countries where Luxe's service providers operate.

Where required by applicable law, Luxe uses appropriate mechanisms and safeguards for international transfers of personal data.

10. Cookies, Analytics, and Tracking

Luxe uses cookies, local or session storage, and similar technologies necessary to operate the Service, including authentication and session functionality.

We may use analytics and monitoring technologies to understand platform usage, maintain reliability, diagnose technical issues, and improve Luxe.

Luxe does not use third-party advertising cookies to sell personal data or serve targeted advertising based on Luxe activity.

11. Security

Luxe uses administrative, technical, and organizational safeguards designed to protect personal data, including TLS 1.2+ encryption in transit, encryption at rest, and access controls.

Audio recordings are stored using access-controlled cloud infrastructure.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

12. Children's Privacy

Luxe is a business platform intended for retail professionals aged 18 and older.

We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child in violation of applicable law, we will take steps to delete it.

If you believe a child has provided personal information to Luxe, contact hello@luxeretail.co.

13. Lawful Bases for Processing

Where the GDPR, UK GDPR, or similar laws apply, Luxe processes personal data under one or more applicable lawful bases, including:

Consent — where we ask you to affirmatively consent to particular processing, including applicable third-party AI processing. Contract — where processing is necessary to provide Luxe and perform our contractual obligations. Legitimate Interests — where appropriate for purposes such as platform security, fraud prevention, service reliability, and product improvement, provided those interests are not overridden by applicable individual rights. Legal Obligation — where processing is necessary to comply with applicable law.

Where processing is based on consent, you may withdraw that consent at any time. Withdrawal does not affect processing lawfully performed before withdrawal.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to Luxe, our data practices, legal requirements, or other operational considerations.

When required, material changes will be communicated through the Service, by email, or by another appropriate method.

The "Last updated" date above indicates when this Privacy Policy was most recently revised.
